Former Chrysler dealers could reopen under appeals court ruling

Years after the bankruptcies and subsequent bailouts of Chrysler (now FCA) and General Motors, the automotive industry is still seeing legal decisions about them come through the courts. The latest ruling from a US appeals court has given 4 of the 789 dealers that Chrysler closed in its Chapter 11 process one less hurdle towards reopening. Following the bankruptcy, 105 of the shuttered dealers went through an arbitration process in hopes of reopening, and 32 won their arguments. However, a victory in that undertaking didn't necessarily mean that the stores could reestablish themselves. For these three showrooms in Michigan and one in Las Vegas, state laws allowed nearby competitors from the same automaker to stand in the way of restarting, according to Automotive News. This problem brought yet another lawsuit, and a US district court found that the arbitration decisions did not overrule state laws. The latest appeals court ruling overturned that decision. However, as with many legal proceedings, the process for reopening for these dealers still isn't exactly easy. The latest decision only covers the nearby dealers' ability to protest; it doesn't mandate FCA actually to open the stores again. According to a statement from Michael Palese of FCA legal communications to Automotive News, the ruling, "did not provide for reinstatement of the dealers who prevailed in arbitration, but only gave them a right to a 'customary and usual' letter of intent." It means for these showrooms to start selling again, now they need to work things out with Chrysler's new owner.

Fiat Chrysler Australia executive in trouble over misuse of company funds

While the merger to create FCA was coming together, its managing director for Australia, Clyde Campbell, was allegedly racking up 30 million Australian dollars ($23.1 million) in spending for himself, family, and friends. Now, the former boss is facing a court case from the automaker's legal team for the purported misappropriation. Among the more opulent expenses that Campbell allegedly put on Chrysler's tab included a 40-foot yacht worth the equivalent of $308,000 and lavish Christmas parties for workers, according to The Age. Despite being required to only travel in economy class and get permission for international travel, he also reportedly racked up the equivalent of over $413,000 travel expenses. "The more we dug, the more we found," said an unnamed source to The Age. Campbell came to power in Australia as a general manager for DaimlerChrysler, and became managing director in October 2010. He was reportedly a close friend with former Mercedes-Benz USA CEO Ernst Lieb. After Lieb lost his wrongful dismissal lawsuit, Campbell allegedly helped his friend's partnership in an Aussie auto dealer by using FCA funds for financial support totaling the equivalent of about $3 million. All of this came to light when Pat Dougherty came over from the US to be president and CEO of FCA Australia in December 2014. The staff spilled the full story on Dougherty's first day. "I walked into his office and let it all out. I don't think he knew what hit him," another source said to The Age. A team of forensic accountants was brought in to investigate. The reason that this took so long to discover was that no one was paying attention. First, sales in Australia were growing under Campbell. Also, "in my opinion, back in Michigan, head office didn't have its eyes on the road. They only had eyes on the Fiat deal," an insider said to The Age. FCA's SEMA vans: A Ram ProMaster bar and a Mopar'd Pacifica

For this year's SEMA show, FCA created six machines that range from mild to wild, and what we have here are the two mildest examples: a custom Ram ProMaster and an accessorized Chrysler Pacifica. Of the two, the ProMaster is easily the more interesting. It's called the BrewMaster and it's a rolling bar. Get it? View 11 Photos The pub-themed interior has a variety of custom touches, including Mopar neon signs and beer taps with shift-knob handles. The outside gets some conceptual parts as well. The grille loses the crosshair design in favor of a large-font "RAM" badge in the center, similar to the one on the Ram Rebel. It also gets some custom 20-inch wheels and large fender flares to accommodate the wider rubber. The message here: Don't drink and drive, but definitely drive somewhere and drink. The Pacifica has far fewer custom goodies, and, sadly, no Hellcat powertrain, but that means what you see is something you could realistically replicate at a dealer. Called the Pacifica Cadence, this van is a rolling showcase of Mopar accessories. The newest piece is a running board that is designed to look like part of the sheetmetal, as opposed to a tacked-on aftermarket accessory. We'd say it's fairly successful if not super-exciting. View 7 Photos The Pacifica also features loads of other Mopar bits including the roof rack, dog kennel, all-weather floor mats, and wireless charging pad. Aside from the custom wrap and painted wheels, you could outfit your own Pacifica identically using a Mopar catalog. As for the BrewMaster, that might require a bit more custom work.
