GM seeks appeals court ruling to continue legal fight with Fiat Chrysler

DETROIT — General Motors on Friday asked a U.S. appeals court to allow it to continue pursuing its civil racketeering suit against rival Fiat Chrysler Automobiles, rejecting a lower court judge's belittling of the complaint. The automaker's filing with the Sixth Circuit Court of Appeals comes less than a week after U.S. District Court Judge Paul Borman called GM's suit against Fiat Chrysler a "waste of time and resources" at a time when both automakers should be focused on surviving the coronavirus pandemic. Borman ordered GM Chief Executive Mary Barra and Fiat Chrysler CEO Mike Manley to meet by July 1 to negotiate a resolution. "As we have said from the date this lawsuit was filed, it is meritless," FCA said on Friday. "FCA will continue to defend itself vigorously and pursue all available remedies in response to GM's groundless lawsuit. We stand ready to comply with Judge Borman's order," it added. In its motion, GM asked the appeals court to throw out Borman's order and reassign the case to a different district court judge. It called Borman's order "unprecedented" and "a profound abuse" of judicial power. GM sued Fiat Chrysler last year, accusing the Italian-American company's executives of bribing United Auto Workers union officials to secure labor agreements that put GM at a disadvantage. Fiat Chrysler is under investigation by the U.S. Justice Department as part of a wide-ranging probe of UAW corruption. GM's accusations came as Fiat Chrysler and French automaker Peugeot were in the early stages of preparing for a merger. Fiat Chrysler has said the suit was aimed at disrupting that deal. GM has said the suit has nothing to do with the merger. In a statement, GM rejected Borman's characterization of the suit as a "distraction" and defended its decision to press the case. "We filed a lawsuit against FCA for the same reason the U.S. Department of Justice continues to investigate the company: former FCA executives admitted they conspired to use bribes to gain labor benefits, concessions and advantages. FCA withdraws its offer to merge with Renault

UPDATE: Fiat Chrysler Automobiles released a statement confirming that it has withdrawn its merger offer, saying "it has become clear that the political conditions in France do not currently exist for such a combination to proceed successfully." Fiat Chrysler has withdrawn its $35 billion merger offer for Renault, the Wall Street Journal and Bloomberg News reported on Wednesday. A source said that FCA had informed Renault it had withdrawn the offer after Renault's board of directors failed to reach a decision on the merger during a meeting that ran late into the night Wednesday. Instead, the board granted the French government's request to postpone its vote. The government wanted time to persuade Renault's reticent alliance partner Nissan. Renault's board issued a press release that said simply that it was "unable to take a decision due to the request expressed by the representatives of the French State to postpone the vote to a later Council." WSJ reported that Nissan's two members on Renault's board were balking, while the rest of the board favored the merger. The French government wouldn't it back the deal unless Nissan agreed to maintain its role in the Renault-Nissan alliance, sources said. Nissan had received little advance warning of the merger proposal and was balking. Apparently the French government thought Nissan could be brought around if given more time. "We should take our time to make sure that things are done well," French Finance Minister Bruno Le Maire told French television on Wednesday. When the French requested a delay and Renault's board granted it, FCA withdrew. The French state, which owns 15% of Renault, had also been seeking more influence over the merged company, firmer job guarantees and improved terms for Renault shareholders in return for blessing the $35 billion tie-up. The merger would have created the world's third-biggest automaker with combined sales of 8.7 million vehicles per year, and was intended to cut costs as the parties develop electric and autonomous vehicles. The Chrysler Pacifica Hybrid is a compelling minivan, which feels less weird to say the more we say it (and the more we drive it). Adding a plug-in powertrain to an already solid family hauler makes it more interesting, and leaves the world just a little less greenhouse-gassy for those children you'll be carrying around in it. So, when we had the chance to actually take one home with us, we strapped in the car seat and put it through some real-world usage. For reference, the non-hybrid Pacifica comes with the standard Pentastar 3.6-liter V6, connected to a nine-speed automatic transmission. It provides 287 horsepower and offers 19 miles per gallon city, 28 highway, and 22 combined. The Pacifica Hybrid adds two electric motors and a variable transmission to its more efficient, less powerful Atkinson cycle V6, providing a total of 260 horsepower. The Hybrid also has a 16-kWh battery pack to power its electric driving. It's rated at a combined 84 miles-per-gallon equivalent. Our test kid, Wolfgang, loved the Pacifica Hybrid. He repeatedly asked for rides, which is not unusual, but seemed to prefer the Chrysler to his other options. He even got upset the one time we put him in Mama's Mercedes GLK while the Pacifica was in the driveway. Wolfgang especially loved the buttons to open and close the automatic doors. After heading indoors, he'd occasionally point out the window toward the minivan saying, "Button." He also thought the horn was hilarious. He's heard his fair share of car horns so far in his young life, but none have ever gotten the same belly laughs that the horn in the Pacifica evoked. We have no idea why. The LATCH anchors were prominent, and easy to find by feel when reaching over the seat.
