Dealer chain accuses FCA of paying dealers to pad sales [UPDATE]

UPDATE: The story has been updated to include a full press release from Fiat Chrysler Automobiles on the Napleton Automotive Group's allegations. A Chicago-based dealership group has filed an explosive lawsuit against Fiat Chrysler Automobiles accusing the company of paying dealers to fake new-vehicle sales, Automotive News reports. Edward Napleton, president of the Napleton Automotive Group, filed the suit on Tuesday. It claims that FCA offered Napleton money to fudge end-of-month sales figures. According to the filing, dealers would report false transactions, only to "back out" at the start of a new month "before the factory warranty on the vehicles could be processed and start to run." According to Automotive News, FCA was aware of the false reports and rewarded dealership managers for hitting sales targets. The lawsuit cites one example at Napleton Arlington Heights Chrysler Jeep Dodge Ram where an FCA business center manager offered Napleton $20,000 "to falsely report the sales of 40 new vehicles." The payment would be disguised "as a co-op advertising credit to the dealer's account." Such a move would prevent a sales audit, AN reports. Napleton rejected the deal, telling FCA it was illegal. He later learned a similar arrangement was made with a competing dealer to falsify the sale of 85 vehicles. They were given "tens of thousands of dollars as an illicit reward for their complicity in the scheme." FCA has vehemently denied the accusation in a statement obtained by Automotive News. "While the lawsuit has not yet been served on FCA US, the company believes that the claim is without merit and was filed by internal counsel to the dealer group as FCA US has concurrently been discussing with the dealer group the need to meet its obligations under some of its dealer agreements," the statement said. "The company is confident in the integrity of its business processes and dealer arrangements and intends to defend this action vigorously." There are additional allegations, as well, claiming FCA "strong-armed its dealers to achieve sales numbers" and accusing the company of maintaining a "pattern of conduct towards its dealers [that] has been one of coercion and threats of termination having nothing to do with the actual performance of its dealers." Man escapes attempted carjacking and catches the incident on his dashcam

A quick-thinking driver avoided a potentially dangerous situation this week in New Mexico when he evaded and attempted car jacking. On the evening of December 6, an unnamed man accompanied a friend to a market near the intersection of Central and San Mateo in Albuquerque. After he saw his friend safely away in her car, he got back into his and pulled out of the parking lot. Almost immediately, as shown in dashcam footage uploaded to Youtube, a red Chrysler 300 began following him. When the driver pulled up to a stop sign around the block from the market, the Chrysler zipped around and pulled in front of him, blocking his forward progress. Figuring he was about to be carjacked, the driver threw the car into reverse and backed quickly away from the Chrysler. The Chrysler followed, and a chase ensured. With the Chrysler close on his tail, the unnamed driver fled through the nearly empty streets. At one point he cut through a gas station when the Chrysler tried to block him at another intersection. As they drove through the city the Chrysler continually tried to stop the fleeing driver, but he successfully evaded every time. The driver called 911 and reported his predicament. Eventually, both vehciles pulled up at a stop light right next to an Albuquerque Police cruiser. The driver laid on the horn to get the cop's attention, then jumped out to tell the cop what was going on. The Chrysler then made a run for it with the cop in hot pursuit. Unfortunately, the red Chrysler evaded the APD and the car's license plate was obscured so the APD was unable to identify the vehicle or its occupants. Thankfully no one was hurt during the chase, and the driver was able to get home safe and sound. Carjacking is a serious crime. The driver in this video did everything right, except maybe delay calling the police a little too long. The crime is so prevalent that the US Department of Justice has tips for avoiding carjacking. They suggest drivers avoiding stopping when signaled by other drivers or assisting during an accident. Calling the authorities should be your first step if you're every followed or harassed while driving. Head to the nearest police station if you can't get a hold of a cop in time. Feds sue Fiat Chrysler, accuse it of cheating on diesel emissions

WASHINGTON - The US government has filed a civil lawsuit accusing Fiat Chrysler Automobiles NV of using software to bypass emission controls in diesel vehicles. The Justice Department suit, filed in US district court in Detroit, is a procedural step that may ramp up pressure on Fiat Chrysler. The suit could ultimately help lead to a settlement, as in an earlier probe of rival Volkswagen AG that will cost VW up to $25 billion, but which affected a much larger number of vehicles. VW admitted to intentionally cheating while Fiat Chrysler denies wrongdoing. It did not immediately comment on Tuesday. US-listed Fiat Chrysler shares were down 2.9 percent at $10.44. The suit also names Fiat Chrysler's unit V.M. Motori SpA, which designed the engine in question. Reuters reported last week the Justice Department and EPA have obtained internal emails and other documents written in Italian that look at engine development and emissions issues that raise significant questions. The investigation has scrutinized VM Motori. FCA acquired a 50 percent stake in VM Motori in 2010 and the remainder in October 2013. The lawsuit asserts the Italian-American automaker placed undeclared "defeat devices," or auxiliary emissions controls, in 2014-2016 Fiat Chrysler diesel vehicles that led to "much higher" than allowable levels of nitrogen oxide, or NOx pollution, which is linked to smog formation and respiratory problems. The suit seeks injunctive relief and unspecified civil penalties. EPA said in January the maximum fine is about $4.6 billion. In January, EPA and California accused Fiat Chrysler of illegally using undisclosed software to allow excess diesel emissions in 104,000 U.S. 2014-2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks. Fiat Chrysler said on Friday it plans to update software that it expects will resolve the concerns of U.S. regulators about excess emissions in those vehicles. The January notice was the result of regulators' investigation of rival Volkswagen, which prompted the government to review emissions from all other passenger diesel vehicles. Volkswagen admitted in September 2015 to installing secret software allowing its cars to emit up to 40 times legal pollution levels. In total, VW has agreed to spend up to $25 billion in the United States to address claims from owners, environmental regulators, states and dealers and offered to buy back about 500,000 polluting US vehicles.
