FCA's U.S. sales chief sues company for wrongful retaliation

Some fresh controversy is brewing at Fiat Chrysler Automobiles as The Detroit News reports that the head of U.S. sales has filed a federal whistleblower lawsuit against the company.. Reid Bigland, who's also in charge of the Ram truck brand, alleges that FCA made him a scapegoat for wrongful sales inflation practices and fixing vehicle sales statistics, which are currently under investigation by federal agents. Bigland claims that FCA executives punished him for cooperating with the federal investigators in the case by cutting his pay by more than 90 percent, according to the lawsuit he filed. The plan apparently was to use the money saved to pay for fines following any settlements made with the Securities and Exchange Commission. So far, the lawsuit alleges that FCA cost Bigland over $1.8 million in income. "They had the largest growth in retail sales in 17 years last year and refuses to pay him," Deborah Gordon, Bigland's lawyer in the case, said to The Detroit News. "Why is that? Because he participated in the SEC investigation and they don't like what he said." Bigland claims he just cooperated with the SEC investigation by testifying about FCA's sales reporting, from the time he took the position to the period prior to being appointed the company's U.S. sales chief. "In late 2018, presumably as a way to wrap up their investigation with some result, the SEC suggested to plaintiff that he admit to some wrongdoing as to defendants' monthly sales reporting," Gordon further said in a statement as part of the lawsuit. "The SEC also suggested a resolution involving some penalty to FCA. Because (Bigland) had not engaged in any wrongdoing, and there was no wrongdoing, he declined to do so." However, exacerbating the issue is the fact that Bigland reportedly sold his shares in the company last year, prompting FCA to act against him even more. FCA came under fire recently by federal agents in at least two separate investigations, potentially exposing conspiracy and corruption between company executives and private entities. The investigations are being led independently by the U.S. Attorney's Office and the FBI. So far, eight convictions were reportedly secured, with one including former Fiat Chrysler Automobiles Vice President Alphons Iacobelli, as one of the defendants. Iacobelli was one of the former top labor-relations executives for the automaker.

Man escapes attempted carjacking and catches the incident on his dashcam

A quick-thinking driver avoided a potentially dangerous situation this week in New Mexico when he evaded and attempted car jacking. On the evening of December 6, an unnamed man accompanied a friend to a market near the intersection of Central and San Mateo in Albuquerque. After he saw his friend safely away in her car, he got back into his and pulled out of the parking lot. Almost immediately, as shown in dashcam footage uploaded to Youtube, a red Chrysler 300 began following him. When the driver pulled up to a stop sign around the block from the market, the Chrysler zipped around and pulled in front of him, blocking his forward progress. Figuring he was about to be carjacked, the driver threw the car into reverse and backed quickly away from the Chrysler. The Chrysler followed, and a chase ensured. With the Chrysler close on his tail, the unnamed driver fled through the nearly empty streets. At one point he cut through a gas station when the Chrysler tried to block him at another intersection. As they drove through the city the Chrysler continually tried to stop the fleeing driver, but he successfully evaded every time. The driver called 911 and reported his predicament. Eventually, both vehciles pulled up at a stop light right next to an Albuquerque Police cruiser. The driver laid on the horn to get the cop's attention, then jumped out to tell the cop what was going on. The Chrysler then made a run for it with the cop in hot pursuit. Unfortunately, the red Chrysler evaded the APD and the car's license plate was obscured so the APD was unable to identify the vehicle or its occupants. Thankfully no one was hurt during the chase, and the driver was able to get home safe and sound. Carjacking is a serious crime. The driver in this video did everything right, except maybe delay calling the police a little too long. The crime is so prevalent that the US Department of Justice has tips for avoiding carjacking. They suggest drivers avoiding stopping when signaled by other drivers or assisting during an accident. Calling the authorities should be your first step if you're every followed or harassed while driving. Head to the nearest police station if you can't get a hold of a cop in time. Former Chrysler dealers could reopen under appeals court ruling

Years after the bankruptcies and subsequent bailouts of Chrysler (now FCA) and General Motors, the automotive industry is still seeing legal decisions about them come through the courts. The latest ruling from a US appeals court has given 4 of the 789 dealers that Chrysler closed in its Chapter 11 process one less hurdle towards reopening. Following the bankruptcy, 105 of the shuttered dealers went through an arbitration process in hopes of reopening, and 32 won their arguments. However, a victory in that undertaking didn't necessarily mean that the stores could reestablish themselves. For these three showrooms in Michigan and one in Las Vegas, state laws allowed nearby competitors from the same automaker to stand in the way of restarting, according to Automotive News. This problem brought yet another lawsuit, and a US district court found that the arbitration decisions did not overrule state laws. The latest appeals court ruling overturned that decision. However, as with many legal proceedings, the process for reopening for these dealers still isn't exactly easy. The latest decision only covers the nearby dealers' ability to protest; it doesn't mandate FCA actually to open the stores again. According to a statement from Michael Palese of FCA legal communications to Automotive News, the ruling, "did not provide for reinstatement of the dealers who prevailed in arbitration, but only gave them a right to a 'customary and usual' letter of intent." It means for these showrooms to start selling again, now they need to work things out with Chrysler's new owner.
