GM isn't liable for punitive damages in ignition switch cases
Wed, Nov 20 2019NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Recharge Wrap-up: NEDC's NOx problems, autonomous Chevy Volts
Mon, Dec 7 2015The International Council on Clean Transportation (ICCT) found a significant difference in NOx emissions in Euro 6 diesel cars in NEDC and WLTC testing. While 88 percent of the cars tested met emissions standards for NEDC, NOx emissions averaged five times higher under WLTC, with only 27 percent of vehicles under the limit. WLTC is considered to be a more realistic driving cycle, using hot starts and factoring a higher top speed as well as harder and more frequent accelerations than the NEDC. Employees will be able to use a carsharing app to reserve a car, which will then drive itself to the set destination. The project will allow GM to collect important data and experience to help the company more quickly develop autonomous driving technology. The lithium-ion batteries used to power the EV were recycled from other Renault EVs. With the electric Trafic, Carwatt – a company that converts vehicles to use electric power – aims to demonstrate the "circular economy" of batteries, which can provide more value through a longer lifecycle. Read more in the press release below. Carwatt presents a unique automotive application for second-life batteries from electric vehicles. On the sidelines of the COP21 summit, in the Solutions Gallery running from 2 to 9 December 2015 in Le Bourget near Paris, Carwatt and its partners —Renault, Paris City Council, BPI France, the Ales Ecole des Mines Engineering School, and the Bobigny Business Campus — are showing a very special electric Renault Trafic. This prototype vehicle, the only one of kind in the world, is powered by second-life lithium-ion batteries recycled from Renault electric cars. Circular economy at work with electric vehicles When, over time, the batteries of a Renault electric vehicle fall the performance threshold specified for their initial automotive power duty (around 75% of initial capacity), they can still provide valuable service in "second-life" applications before end-of-life disposal at a recycling centre. Experiments are already under way on power storage applications, for example.
Chevy up to old EVs-equal-range-anxiety tricks in new Volt Olympics ad
Fri, Feb 14 2014General Motors is at it again with a new Chevrolet Volt TV commercial. Viewers of the Winter Olymics (at least in some markets) recently saw a TV ad in between the skating and the skiing that made no mention of the environmental benefits or freedom from the power of Big Oil that electric vehicles provide. No, this one was based on pure survival instinct. In the video, a father is driving down a highway, perhaps through the Mojave Desert. His young son is sitting in the Volt's backseat and asks what happens when the EV's battery runs out. "We'll have to cross that burning desert with snakes and cactus until we make it back to civilization," the dad tells his son as they pass the skeleton of a fallen bull. The fine print makes it clear that the actual maximum range is 342 miles. But there is hope. The father tells his son, with a beaming smile on his face, that the gas generator has kicked in and they're going to make it through the desert. As they wend their way to the horizon, a voice over says that Volt drivers who charge up regularly are making it 900 miles between fill ups. The fine print makes it clear that the actual official maximum range before you need to either plug in or fill up is 342 miles. This theme that emphasized range anxiety has been utilized by GM since the extended range Volt was launched in late 2010, despite the fact that Chevrolet now offers an all-electric vehicle in the Spark EV. Volt fans are praising the commercial, called The New Freedom, on the GM-Volt forum and you can see for yourself below. This content is hosted by a third party.
