GM won't pay owners of recalled cars for lost value
Thu, 12 Jun 2014Kenneth Feinberg, the man in charge of the General Motors compensation fund dealing with the its widespread ignition switch woes, has issued an informal, two-letter response to the plaintiffs in more than 70 lawsuits seeking redress for lost resale value of their Cobalts: "No." The cases were recently combined into one, but Feinberg told The Detroit News that the fund will deal "only with death and physical injury claims," and that "perceived diminished value" will get no consideration.
ALG, the firm specializing in establishing residual values, determined that Cobalt owners had lost $300 compared to the segment competition and doesn't envision any long-term effects from the recall situation. Feinberg's statement comes in advance of public details on how the compensation fund will work and adheres to GM's long-held position on the matter. The company has already asked a judge to throw out such suits using the pre-bankruptcy defense, even as it stopped using that defense in cases of injury and death.
With plenty of potential gain from the GM suit, however, don't expect the plaintiffs to give up yet. When Toyota was sued for the same reason during the unintended acceleration debacle, it eventually settled the case for between $1 billion and $1.4 billion just to get it over with. Since the 85 law firms involved in the Toyota litigation took home more than $250 million of that total, we shouldn't expect the attorneys to give up on a GM payout, either.
2016 Chevy Colorado and GMC Canyon recalled for opening console lids
Mon, Dec 28 2015The Basics: General Motors is recalling 9,200 examples of the 2016 Chevrolet Colorado with build dates between August 25, 2015 and September 24, 2015, and the 2016 GMC Canyon manufactured from August 28, 2015 to September 24, 2015. In total, 8,763 of these pickups are in the US, and the rest are in Canada or Mexico. The Problem: The console compartment lid could open in a crash, and the items inside the storage compartment might hit occupants during the accident. This fault puts the pickups out of compliance with the Federal Motor Vehicle Safety Standard. Injuries/Deaths: None reported. The fix: Dealers will replace the console compartment door latch assembly with an improved part. If you own one: GM has not yet told NHTSA when the repairs for these pickups begin. Viewers of the Winter Olymics (at least in some markets) recently saw a TV ad in between the skating and the skiing that made no mention of the environmental benefits or freedom from the power of Big Oil that electric vehicles provide. No, this one was based on pure survival instinct. In the video, a father is driving down a highway, perhaps through the Mojave Desert. His young son is sitting in the Volt's backseat and asks what happens when the EV's battery runs out. "We'll have to cross that burning desert with snakes and cactus until we make it back to civilization," the dad tells his son as they pass the skeleton of a fallen bull. The fine print makes it clear that the actual maximum range is 342 miles. But there is hope. The father tells his son, with a beaming smile on his face, that the gas generator has kicked in and they're going to make it through the desert. As they wend their way to the horizon, a voice over says that Volt drivers who charge up regularly are making it 900 miles between fill ups. This theme that emphasized range anxiety has been utilized by GM since the extended range Volt was launched in late 2010, despite the fact that Chevrolet now offers an all-electric vehicle in the Spark EV.
