GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. When General Motors created the Geo brand to sell vehicles designed and — in some cases — built by Japanese partners, the first four models were introduced for the 1989 model year: the Metro (Suzuki Cultus), Prizm (Toyota Sprinter), Spectrum (Isuzu Gemini) and Tracker (Suzuki Sidekick). Geo got the axe in 1997, with the Metro, Prizm and Tracker becoming Chevrolets. Of those, the Tracker survived the longest, with U.S.-market sales continuing into 2004. Here's an example of a very late Tracker, found in a North Carolina car graveyard recently. The 1989-1997 first-generation Trackers were based on the Suzuki Sidekick, while the 1998-2004 Trackers had the Suzuki Vitaras (not to be confused with the much grander Grand Vitaras) as their siblings. Production of these trucks for the South American market (as the Chevrolet Vitara) continued in Ecuador all the way through 2014. The Tracker name has also gone onto some versions of the Chevrolet Trax around the world. This one is a base four-door hard top/rear-wheel-drive model, which had an MSRP of $17,330. That's about $29,789 in 2024 dollars. You'll find one in every car. You'll see. The engine is a Suzuki 2.0-liter straight-four rated at 127 horsepower and 134 pound-feet. A five-speed manual was base equipment, but very few American vehicle shoppers wanted three pedals by the middle 2000s. This truck has the Aisin four-speed automatic. We like it loud. It appears that someone associated with this truck graduated from Julius L. Chambers High School last year. In the United States, the Tracker was replaced by the Saturn Vue. Recharge Wrap-up: Ford HQ gets giant solar array, Chevy City Express gets 24 MPG city

Ford will be building Michigan's largest solar array at its Dearborn headquarters. With funding from DTE Energy, the solar carport will provide covered parking, as well 30 charging stations for electric vehicles. Chevrolet announced the fuel economy for the 2015 City Express, at 25 mpg combined. The cargo van is rated at 24 mpg in the city, and 26 mpg on the highway. Chevy credits the van's inline four-cylinder engine and continuously variable transmission for its impressive city mileage. For its customers - which are mainly businesses - "The fuel economy of the City Express will help stretch their dollar at the pump and give them the flexibility to invest the savings back into their business," says Chevrolet's Ed Peper. The City Express starts at $22,950. Read more in the press release below. Engineers at the University of Wisconsin have developed an efficient engine that runs on a diesel-gas blend. The engine, which uses a computer to control the blend proportions, is about 15 percent more efficient than the any diesel engine according to mechanical engineering professor Rolf Reitz. The team has put the experimental reactivity controlled compression ignition (RCCI) engine in a demonstration car - a 2009 Saturn. "This vehicle can do 50 miles per gallon," says Reitz, who believes the system could be improved further. Read more at Wisconsin Public Radio.
