GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Bentley has been awarded the Carbon Trust Standard for reductions of carbon, water use and waste production in manufacturing. The Carbon Trust is an organization that helps groups such as businesses and governments reduce carbon emissions, use of energy and resources, and waste output. From 2011 to 2013, Bentley reduced CO2 emissions by 16 percent per car manufactured, curtailed water use by 35.7 percent, and saw significant waste reductions. Darran Messem of Carbon trust says, "Bentley is clearly passionate about continuing to improve its environmental performance, which is reflected by the fact the company has consistently invested in new technology." The organization will use the range-extended electric cars in its efforts to help MBA students learn from and work with small business owners. As part of the MBAs Across America program's first year, four students drove 8,000 miles to provide entrepreneurs with free business counseling. The program has expanded, and this year, teams of MBAs will use the Volts to travel to 25 cities to offer their services. A professor from the University of Michigan has found fuel cycle analysis to be too flawed to be relied upon for measuring CO2 impacts of transportation fuels. Professor John DeCicco of the university's Energy Institute feels that the flaws in calculating the carbon footprint of liquid fuel production and combustion make such lifecycle analysis impractical. He suggests, instead, to focus to carbon capture. Since capturing CO2 directly from a vehicle is probably never going to happen, DiCicco believes the solution is to capture carbon from the atmosphere in sectors outside of transportation. Says DiCicco, "Research should be ramped up on options for increasing the rate at which CO2 is removed from the atmosphere and on programs to manage and utilize carbon fixed in the biosphere, which offers the best CO2 removal mechanism now at hand. Such strategies can complement measures that control the demand for liquid fuels by reducing travel activity, improving vehicle efficiency and shifting to non-carbon fuels." GM's European Opel division may eventually go all-electric

General Motors' Opel division in Europe may transform itself into an all-electric vehicle maker by 2030. Granted, a lot can happen between now and then, including a potential buyout by French automaker PSA Group. Regardless, Opel appears to view its electric future beyond the Ampera-e, which is the sister vehicle to the Chevrolet Bolt, and more like Tesla. Opel CEO Karl-Thomas Neumann indicated that focusing on electric drivetrains would be a superior strategy to expanding its EV technology while pushing forward with conventional drivetrains, says Automotive News Europe, citing comments Neumann made to German publication Manager Magazin. General Motors could make the decision to move towards an all-electric vehicle line for Opel as soon as May. Of course, that depends on whether Opel is bought out by PSA, the parent country to Peugeot and Citroen. PSA is in talks to buy General Motors' Opel and Vauxhall divisions, though government and labor representatives in Germany have expressed concerns over potential job losses from the proposed buyout, Reuters says. Regardless, GM has hinted at expanding its electric-vehicle line far beyond the Bolt, which has a 238-mile single-charge range and debuted late last year. Mary Barra, in an interview with CNET, said the Bolt's all-electric platform could be applied to a "huge range of vehicles," though wasn't specific about additional EV models. Opel first showed off its Ampera-e at the Paris Motor Show last fall. The name of the model raised some eyebrows because the Ampera badge had been previously used by Opel for the sister version of the Chevrolet Volt extended-range plug-in. Either way, Opel is looking to take on Renault for electric-vehicle sales supremacy across the Pond. Related Video:
