GM does not have to turn over its ignition switch documents

In June the lawyer representing plaintiffs suing General Motors over faulty ignition switches accused GM and its firm King & Spalding of working together to cover up the malfunction. Bob Hilliard said that certain communication between GM and King & Spalding from 2010 to 2013, mainly focused on three Chevrolet Cobalt crashes, would reveal that they conspired in "burying what they knew" concerning the defect, and furthermore that the law firm broke rules of professional conduct once it found out about "ongoing fraudulent concealment" at GM. Hilliard filed a motion in a Manhattan court to force GM and King to hand over the memos, which were protected by attorney-client privilege. Hilliard said that the alleged ongoing fraud should trump attorney-client privilege, a GM spokesman said at the time that the issues in question had already been discussed previously, and that plantiffs already had much of the communication Hilliard's motion sought. US District Judge Jesse Furman ruled in favor of GM and King, refusing to order the release of the communication. In spite of finding probable cause that GM was engaging in a crime or fraud by not revealing the ignition switch defect, Furman did not find cause to believe that GM and King's discussions at the time were centered around continuing that potential crime or fraud. Saying also that plantiffs already had many of the disputed documents, attorney-client privilege should hold sway over the remainder. The class action case goes to trial in January 2016.

Recharge Wrap-up: Chevy Spark EV in Canada, Audi to use Valeo electric supercharger

The Chevrolet Spark EV will become available to retail customers in Canada. "We're expanding our electric vehicle offerings to our customers by offering the 2016 Spark EV for retail sales in the growing EV markets here in Quebec as well as in Ontario and BC," says Chevrolet's Chris Hay. Chevrolet has not yet released pricing for the Spark EV in Canada. In the US, the Spark EV is available in California, Oregon and Maryland. Read more at Hybrid Cars. Four recreational vehicle companies in Texas have settled with the EPA over illegal import and sale of off-road vehicles. The 4,000-plus Hammerhead brand vehicles in question were imported without the proper certification, a violation of the Clean Air Act. Some vehicles lacked proper emission control equipment or were manufactured by a company not listed on the certificate application. The settlement totals $560,000 in civil penalties for the companies involved. Read more from the EPA. The Iowa Supreme Court has upheld the state's natural gas tax, which was challenged by the ethanol industry. Ethanol producers, which use natural gas to make ethanol, argued the complicated tax was unconstitutional, as it forced certain plants to pay more than their competitors. Taxes vary by location, and some plants have to tap into interstate pipelines at much higher tax rates rather than get it from a local utility. Now, ethanol producers will work to change the law. "My hope is that people understand that, something may be constitutional but that doesn't make it good public policy," says Iowa Renewable Fuels Association Executive Director Monte Shaw. Valeo says Audi will launch a vehicle using its electric supercharger next year, with other reports suggesting that car will be the Audi Q7. The company says other unspecified automakers will also use the technology in their vehicles. While the electric supercharger adds to the vehicle's cost and electric energy use, it can improve fuel economy by as much as 20 percent. Read more at Automotive News Europe. These are the five most ridiculous attacks on the Chevy Volt [w/videos]

It's been a long, strange trip for the Chevy Volt from the time when the now-odd-looking concept version (above) was introduced at the 2007 Detroit Auto Show to today. And now, General Motors announced that the second-generation Chevy Volt will make an appearance at the 2015 Detroit show in January. This debut represents a victory for GM with what has easily become the most politicized car of the 21st Century. There are plenty of reasons for someone to criticize the Volt, but what's amazing is just how much anti-Volt energy has been spent not on things like the styling or how the EREV setup is not as efficient as a pure-EV powertrain. As we wait for more official information on the new Volt, we thought it would be fun to go back and look at some of the most wildly incorrect reporting and strangest attacks on the Volt from the archives. There is so much good stuff out there, it was hard to pare the list down, but these are our five favorites. Amazingly, they're not all clips from Fox News. Check 'em out below. 5. GM Is Going To Stop Making The Chevy Volt In The US Do you remember when GM was about to move Volt production to China? Well, yeah, this was reported back in early 2012 when a GM executive mentioned that the automaker would get benefits of building the Volt in the places where it sells them. This was spun into a story of GM taking Obama bailout money and then running to China. The Blaze was not happy: "Given the fact that Federal government helped itself to millions and millions of taxpayer dollars under the pretense that it was going to combat high unemployment by creating 'green jobs,' it would seem that moving research and development (and possibly manufacturing) overseas is slightly, well, counterproductive." Well, of course, that never happened. There's no way to say that GM will never build a version of the Volt in China, but the news we hear rumors of these days is that GM is going to move production of more Volt parts (specifically, the motors) to Michigan from overseas. 4. The Chevy Volt Is A Fire Trap There has never been a Volt that just spontaneously lit up while driving down the road. Yes, there were Volts that caught on fire. Yes, that's a scary thing. But there has never been a Volt that just spontaneously lit up while driving down the road. These were crashed test vehicles with destroyed batteries and plugged-in vehicles that were not the cause.
