GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. The Chevrolet Spark EV will become available to retail customers in Canada. "We're expanding our electric vehicle offerings to our customers by offering the 2016 Spark EV for retail sales in the growing EV markets here in Quebec as well as in Ontario and BC," says Chevrolet's Chris Hay. Four recreational vehicle companies in Texas have settled with the EPA over illegal import and sale of off-road vehicles. The 4,000-plus Hammerhead brand vehicles in question were imported without the proper certification, a violation of the Clean Air Act. Some vehicles lacked proper emission control equipment or were manufactured by a company not listed on the certificate application. The settlement totals $560,000 in civil penalties for the companies involved. Read more from the EPA. The Iowa Supreme Court has upheld the state's natural gas tax, which was challenged by the ethanol industry. Ethanol producers, which use natural gas to make ethanol, argued the complicated tax was unconstitutional, as it forced certain plants to pay more than their competitors. Taxes vary by location, and some plants have to tap into interstate pipelines at much higher tax rates rather than get it from a local utility. Now, ethanol producers will work to change the law. "My hope is that people understand that, something may be constitutional but that doesn't make it good public policy," says Iowa Renewable Fuels Association Executive Director Monte Shaw. Valeo says Audi will launch a vehicle using its electric supercharger next year, with other reports suggesting that car will be the Audi Q7. The company says other unspecified automakers will also use the technology in their vehicles. While the electric supercharger adds to the vehicle's cost and electric energy use, it can improve fuel economy by as much as 20 percent. Read more at Automotive News Europe. GM uses wind power to build SUVs, trucks

This week started with a chill, as the Intergovernmental Panel on Climate Change issued a dire report with scientists warning, "The world we know today is not the world we will see in 50 years," with temperatures rising at their current rates. In the meantime, the trend toward purchasing more SUVs and crossovers continues. Most automakers, though, have set goals toward more sustainable production. That includes General Motors, which, somewhat ironically, plans to use wind power to produce many of its vehicles, including pickups and full-size SUVs. As the Detroit Free Press reports, several wind farms are coming online to support cleaner production as part of a partnership between GM and energy producer CMS Enterprises. At the beginning of October, the 100-megawatt Northwest Ohio Wind Farm began producing energy, supplying GM operations in Ohio and Indiana, where manufactured vehicles include the Chevy Cruze, Chevy Silverado and GMC Sierra. Hilltopper Wind Farm in Illinois will begin producing another 100 megawatts for GM manufacturing in the region. In Texas, where GM builds the Chevrolet Tahoe, Chevrolet Suburban, GMC Yukon, GMC Yukon XL and Cadillac Escalade, the automaker is getting 50 megawatts from Cactus Flats Wind Farm beginning October 9. Using wind power isn't just about being green, but also for the sake of price stability. As Rob Threlkeld, GM's global manager of renewable energy told the Free Press, "You don't get the price spikes this way, like you do with fuel, and it reduces the environment footprint of the vehicle you're driving." Threlkeld said that renewable energy has already meant "millions of dollars in savings" for GM. GM plans to power all of its global operations with renewable energy by 2050. This week, the automaker was ranked 76 on the EPA's "National Top 100 List" of green manufacturers. It was the only automotive company listed.
