GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Meet the Greenest and Meanest vehicles of 2016

If you've been keeping track, you won't be surprised with the number one entry in this year's list of greenest cars from the American Council for an Energy-Efficient Economy (ACEEE). In fact, the top three spots on the 2016 list are all the same as they were in 2015. After that, things get interesting. For one thing, this is the first Greenest list that doesn't have any purely internal combustion engine powertrain on it. Hybrids, yes, but if you want to be one of the top 12 greenest cars this year, you'd better have some sort of electric angle. ACEEE says that the conventional, gas-powered Smart Fortwo and Chevrolet Spark just missed the cut. In a statement, ACEEE lead vehicle analyst Shruti Vaidyanathan said, "The 2016 scores are in, and plug-in electric vehicles are outpacing all other vehicle offerings in terms of environmental friendliness." Like last year, one of the noticeable vehicles missing from the green list is the Tesla Model S. One reason? ACEEE takes curb weight into account (lighter is better), and the Model S is a heavy beast. The ACEEE doesn't just look at the clean side of the ledger. It also puts out a "meanest" list. These are the vehicles that pollute the most, not only from their tailpipes, but also any pollution created during the entire manufacturing process, from mining the raw materials to the energy used to produce the vehicle at the factory. 2014 Chevrolet Corvette Stingray priced from $51,995*

After months of speculation, Chevrolet has finally revealed the official starting price of the 2014 Corvette Stingray. The base MSRP for the 450-horsepower Stingray Coupe will be $51,995, while the Stingray Convertible will go for $56,995 (*both prices include a $995 destination fee). This means that the price increase from 2013 to 2014 is just $1,400 for the coupe and $2,395 for the convertible - pretty modest increases considering the upgrade in specifications. Of course, neither price accounts for the sort of dealer markup that might grace early C7 window stickers, especially since less than a third of all Chevrolet dealers will be allocated Corvette models to sell at the car's launch.
Now, these prices are for the base car, so if you're wondering how much a fully loaded Stingray will run, Chevy has given us a good indication of that as well. The coupe we saw on display at the Detroit Auto Show (shown above), for example, would run $73,360 including options such as the $2,800 Z51 Performance Package, $2,495 competition sport seats and the $1,795 Magnetic Ride Control option - just to name a few. Stepping up to the 3LT trim level that brings a full leather interior will run an extra $8,005 over the base price.
While $20,000 in options may seem like a lot, this "as-tested" price still has the C7 competitively priced against rival coupes like the Porsche 911 and Nissan GT-R. Speaking of price comparisons, Chevrolet also points out that the C7 Stingray Z51 costs $2,200 less than the C6 Grand Sport while delivering better acceleration (0-60 mph in less than four seconds) and improved track performance (including more than 1 g in cornering).
