GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Mustang, Camaro, Challenger gallop onto USPS pony car postage stamp set

Some of America's most iconic cars are about to be immortalized on postage stamps. A new set by the U.S. Postal Service will celebrate the the golden era of pony cars, featuring five classic examples of Detroit iron. Each one is beautifully illustrated in oil-on-canvas style, with subjects in motion and sunlight glinting off the chrome, and would add a nice touch to any first-class letter. The pony car segment was all about (relatively) small, sporty alternatives to the full-size land yachts of the 1960s. They typically came equipped with 6-cylinder engines or small-block V8s. The category was named after the Ford Mustang, hence  the name. Some, though, argue that the Plymouth Barracuda, which was launched a couple of weeks before the Mustang, is the first. Luckily, the Falcon-based Mustang's distinct styling generated a sales sensation, or we might be calling them fish cars. Appropriately, one of the featured cars is a Mustang. But it's not just any Mustang. The 1969 Boss 302, seen here resplendent in Bright Yellow, was created for the hotly-contested SCCA Trans-Am racing series. One of its main rivals would have been the 1969 Chevy Camaro Z/28, also created specifically for the series, and is included in the set in Fathom Green. Representing Auburn Hills in the set is a 1970 Dodge Challenger R/T in Plum Crazy, while Southfield's American Motors gets a nod with an AMC Javelin in Big Bad Orange. The Mustang's platform cousin, a 1967 Mercury Cougar XR-7, is portrayed in a gorgeous Burgundy Poly that almost looks incomplete without Neko Case on the hood. It's not the first time the USPS has honored America's rich car culture on its stamps. In 2013, it issues a series of muscle car stamps with the help of Richard Petty. That set featured a 1966 Pontiac GTO, 1967 Shelby GT-500, 1970 Chevelle SS, 1970 Plymouth Hemi ’Cuda and, of course, a 1969 Dodge Charger Daytona. Another set in 2016 featured classic pickup trucks. Going further back, a 2008 release had chroed and finned automobiles of the 1950s and a 2005 release featured sporty American cars of the same era. The pony car stamps will debut on August 25 at the Great American Stamp Show in Sacramento, California in partnership with the American Philatelic Society. The public is free to attend the dedication ceremony, but you must RSVP first. After that, they will be available at local post offices and on line at the USPS store.

GM recalls 83,572 SUVs for ignition switch issue

General Motors is recalling 83,572 SUVs from the 2011 and 2012 model years over a potential ignition lock actuator issue. In affected vehicles, the actuator isn't the right size, which could cause the ignition to get stuck in the "Start" position, and then either due to a jarring event or a "cool interior temperature" the ignition could switch back to the "Accessory" position. Doing so would cause a loss of power assistance and the airbags might not deploy. This is a different ignition issue than the one that's been ongoing for the past year. GM said it expects that less than 500 vehicles suffer from the problem, but that the pool could include vehicles from 2007 through to 2014 that have already been fixed, but with defective parts. The 2011-2012 SUVs included in the National Highway Traffic Safety Administration notice: Cadillac Escalade, Escalade ESV, Escalade EXT, Chevrolet Avalanche, Silverado HD, Silverado LD, Suburban, Tahoe, GMC Sierra LD, Sierra HD, Yukon, and Yukon XL vehicles. GM will notify owners and dealers will inspect the ignition lock housing to see if it needs a free replacement.
