GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. GM Design shows what could have been and what might be

We periodically like to check in with GM Design's Instagram account to see what they're cooking up. Even better is when we catch a glimpse of an alternate history of what legendary designers from The General's past were thinking, though those ideas may not have made it into production. This week, for example, the account posted some illustrations from George Camp, whose career at GM spanned nearly four decades, from 1963 to 2001. One of the renderings is of what appears to be a 1971-72 Pontiac GTO Judge, but with two headlights instead of the production unit's quad beams. The rear departs from the canonical version most dramatically, with a massive integrated wing. Other bits that didn't make the production cut include large side vents, a gill-like side marker and rectangular intakes below the headlights that wouldn't be out of place on a modern design today. Amazingly, from what we can make out of the date, it appears that the drawing was done sometime in 1965, which makes it quite prescient.           View this post on Instagram                       A post shared by GM Design (@generalmotorsdesign) There's also a very aerodynamic interpretation of a Corvette ZR-1. To our eyes it splits the difference between the 1986 Corvette Indy concept and a fourth-generation F-body Pontiac Firebird, so perhaps parts of Camp's work on this sketch did make it into physical form. There's also a radical sports car concept from May 1970 that resembles the Mazda RX-500 concept from the same year, a Syd Mead-looking Cadillac coupe, and an Oldsmobile with a cool take on the company's trademark waterfall grille and elements of the Colonnade Cutlass at the rear. In total, there were only five traditional ad spots from three big OEMs. A number of car-adjacent ads aired during the Big Game, too, and we’ll bring you those ads in this roundup alongside the more obvious ones. WeÂ’ve compiled all of the automotive-related commercials for you here in this post so you donÂ’t have to go searching for them elsewhere. Read on below to see what aired as the Kansas City Chiefs defeated the Philadelphia Eagles. Ram's Super Bowl spot offers a cure for 'Premature Electrification' This commercial revealed the new electric Ram Rev pickup, and itÂ’s themed like a prescription ad for an antidote to "Premature Electrification.” A concerned narrator in the Ram spot asks if you're afraid that going electric too soon will mean "you might not be able to last as long as you like," and there's a guy on a pier who's going to need some new equipment if he wants to catch fish. We're also told there are "options being designed to extend range in satisfying ways," so if this truck isn't right for you, you have choices. All the commercial's missing is a silly medical marketing name and six seconds of speed-reading gibberish about side effects like intestinal bleeding and death. Which are two more good things. Jeep 4xe Super Bowl commercial highlights modern version of 'Electric Boogie' JeepÂ’s “Electric Boogie” commercial follows the Wrangler 4xe and Grand Cherokee 4xe in a variety of simulated off-road situations. Though fun, the soundtrack is the real star of the show. The songÂ’s original artist, Marcia Griffiths, was joined by Grammy winner Shaggy, Jamila Falak, Amber Lee, and Moyann on the track. The modernized re-recording celebrates 40 years since GriffithsÂ’ original track, and Jeep says the track is available for streaming now. Kia returns to the Super Bowl with the tale of 'Binky Dad' This year, Kia follows the adventure of "Binky Dad" in his quest to fetch his daughter's lost pacifier, which naturally takes him over just about every bit of terrain you might encounter upon leaving the civilized confines of Southern California for the not-so-civilized mountains of ... probably also California. It features the refreshed 2023 Kia Telluride, which probably doesnÂ’t need much advertising to see these days, but Kia went for it with the strong three-row SUV anyway.
