GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. The mid-engine Corvette! We just saw blurry photos through the foliage, and are hearts are all aflutter because it means that this car is real. And it's the most " never before" Corvette since 1984. Which leads us to all kinds of wacky theories and speculation. Everybody knows something or heard from a guy. None of those guys (or gals) from GM are talking to Autoblog, to be clear. But that won't stop us from stirring the pot. Let's go over a few point-by-point. The pushrod engine will be replaced by an overhead-cam V8 Car and Driver has repeatedly reported that an overhead-cam engine will come after the mid-engine Corvette's debut with an old-school pushrod. We've heard the same thing firsthand, albeit from a source with no connection to the development of the Corvette or powertrain. "At some point two valves can't pass future emissions regulations," said the guy we know. While the pushrod engine is compact, the design makes it difficult - if not impossible - for sophisticated variable valve timing (and lift) systems that control combustion with more precision. Hasty conclusion: The pushrod engine has a finite life in front of it. This one's a lock, it's a just a matter of when. The new paint facility costs $439 million dollars and adds 450,000 square feet, almost half the size of the existing plant. Plus GM announced another $290 million in upgrades at Bowling Green Assembly. That sure sounds like a lot of money, but you can actually spend that much on a paint booth. Porsche spent 500 million Euros (about $561 million dollars) to add the Macan assembly to its Leipzig, Germany plant in 2014. Chrysler shelled out $850 million for a paint shop in Sterling Heights, Michigan. GM spent $600 million for a new paint shop at the Fairfax (Kansas City) plant. Honda, on the other hand, is working on a thrifty $210 million project in Marysville, Ohio that includes a 300,000 square foot expansion, and the low-volume Acura NSX facility only cost $70 million. Hasty conclusion: The square footage and cost could easily mean a new assembly line instead of (or in addition to) a paint line. And if the NSX plant was really that cheap, GM could have hidden a similar sum in its existing announcements.

These days there are plenty of vehicles that blur the conventional automotive class structures. For instance, was the Honda Crosstour a wagon or an SUV? And what exactly was the Nissan Murano CrossCabriolet? Regardless, those line-blurring cars (or trucks) are out there, and though this one didn't roll off a production line, it's still quite the automotive head-scratcher. Hailing from Missouri, this epic creation is one part mad science experiment, one part 1947 Chevrolet pickup, and one part '95 Mercury Cougar. Add it all up and you get an awesome truck-sports-car hybrid, complete with an outrageous wing and a V8 to boot. And interestingly enough, it's up for sale . According to the listing, the Chevrolet truck cab (which had previously been chopped) was sanded down to bare metal and given a thorough shellacking of clear coat. It was then melded together with the front end of a 1995 Chevrolet S10 pickup truck, and set low to the ground on Bilstein suspension drop spindles. Stance achieved. But instead of fielding an engine from either of those pickups, it pulls its heart from a 2005 Chevrolet Tahoe SUV—a big 5.3-liter V8 heart, that is. It comes backed-up to a GM Turbo 400 automatic transmission. Towards the rear however is where things get really interesting. A Copper Pearl coated tube frame chassis both attaches the rear independent suspension (a la Mercury Cougar) to the racy spoiler, as well as secures the rat rod's rear-mounted radiator, fan, and fuel tank. I'm not quite sure why, but it just looks glorious. RELATED: Reports Say Mid-Engine Corvette Will Arrive in 2018 Inside the vintage cab, the Chevrolet furthers its racing proclivities (it's said to have won burnout and auto-cross events) with a pair of harnessed racing seats, a drift brake, a detachable steering wheel, and a tachometer with oil and temperature gauges, but oddly no speedometer. The shifter is a crescent wrench. And its shift boot? That's a Crown Royal Purple bag. All in all, this grin-worthy Frankenstein creation tallies up bits and pieces from four different vehicles (five if you include the Camaro wheels), which make it truly a mash-up of epic proportions.
