GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. We hand out this award every year to the technology or feature that we feel moves the bar forward for the automotive industry. Read more here on how our testing process works. We discuss, debate and count up score sheets, judging each vehicle and technology on a few different criteria. Is its purpose noteworthy? Does it work well? Does it advance the industry? The Nissan Rogue with ProPilot Assist was actually a prototype, as the technology will first debut in the 2018 Nissan Leaf. Still, we're here to test the tech and not the car. ProPilot Assist combines adaptive cruise control system combined with lane-keeping assistance. The system uses sonar, radar and a number of cameras for some light semi-autonomous driving and enhanced safety. While these systems aren't new individually, Nissan's system is affordable, intuitive, and coming to a mainstream product — democratizing the tech in a novel way, if you will. That's why it's here. The Lexus LC 500h uses a new powertrain that Lexus has dubbed the Multi-Stage Hybrid System. Basically it combines two types of transmissions — a CVT and a four-speed automatic — in a single unit mated to a naturally aspirated V6. That's complex and unorthodox technology, and Lexus engineered it to give drivers the efficiency of a CVT without sacrificing driving enjoyment. The package is subtle, working in the background to create a nearly seamless driving experience. It's engaging in a way most other hybrids can only dream of. The fact that it's wrapped in such gorgeous sheetmetal only makes things better. The Multimatic spool valve shocks in the Chevy Colorado ZR2 might seem low-tech compared to ProPilot Assist and the Lexus Multi-Stage Hybrid, but they represent a completely novel application of a technology that several years ago was so expensive that it was reserved for top-tier race cars. Like the LC 500h, these shocks really change your perception of how a vehicle like this should drive.

Pics Aplenty: Meet the 2014 Chevrolet Silverado and GMC Sierra [w/poll]

Today was a pretty big day for General Motors, debuting the all-new Chevrolet Silverado and GMC Sierra light-duty pickup trucks ahead of their official showcase at the 2013 Detroit Auto Show. And now that the dust has settled at GM's big reveal event, we've had a chance to snap dozens of photos of the new pickup pair from every angle.
We already told you the important bits earlier today (click here in case you missed it), but let's recap. Under the hood are three new engines - a 4.3-liter V6, 5.3-liter V8 and 6.2-liter V8 (you know, a version of the small-block that'll also be found under the hood of the C7 Corvette), all mated to six-speed automatic transmissions. The 2014 model year marks the return of the Z71 off-road package with Rancho shocks, front tow hooks and beefier underbody protection. Inside, there's a host of new technology and a greater focus on better quality and refinement.
Some of the nitty-gritty specifics (like engine output numbers and fuel economy) have yet to be revealed, and since we haven't driven the finished products yet, it's hard to say how these trucks will fare against rivals like the Ram 1500 and Ford F-150. For now, we can only judge these two books by their covers, and while we do like the designs of the new trucks, we Autoblog staffers are torn on exactly which one looks best.
