GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Pure Vision Design TT Camaro has 1,400 reasons to want it

We've talked about Pure Vision Design before, a California-based company that made waves at last year's SEMA show with its Martini-liveried, Indy-car-powered Ford Mustang. That same car later starred in a Petrolicious video we showed you just a few weeks back. The company's latest creation is a menacing car it calls the Pure Vision Design TT Camaro. Based on a 1972 model, this car shares the Martini Mustang's clean styling and obsession with details.
Unlike the Mustang, which draws its power from a mid-60s Lotus-Ford Indycar engine, the "TT" in this Camaro's name implies something far more potent. The Nelson Racing Engines 427-cubic-inch V8 has been fitted with a pair of turbochargers, with a claimed output of 1,400 horsepower. That's almost 1,000 more than the Martini Mustang.
A six-speed Magnum transmission dispatches that power to the ground, while Pirelli PZero tires are tasked with (somehow) trying to grip the road. Baer brakes hide behind those HRE rims, while JRI coilovers and HyperTech springs bless the Camaro with some degree of competency in the bends.

Next Chevrolet Malibu to have 'groundbreaking,' 'passionate' design

In our First Drive of the Chevrolet Malibu after its redesign in 2013 we wrote, "Chevy has quickly worked up a host of changes for its ever-important midsize sedan, and will be launching this 'there, we fixed it' 2014 Malibu like it's an all-new product." Still, no one cared. The Malibu has been mentioned in eight posts this year, all but two of them dealt with recalls, and one of those two was about a 2011 Malibu university science project. It came up in precisely zero posts from November 2013 to March 2014. That's why, according to a report in Automotive News, Chevrolet honchos are "hustling" to have a new Malibu ready in a year. Mark Reuss, General Motors' head of global product development, said it will have "groundbreaking design" and "groundbreaking technology," and asked investors who were showed a picture of it, "When is the last time you saw a [midsize] car this distinctive and this dramatic from General Motors?" Doubling down on the bullishness, Reuss said, "We've got our act together here on the midsize-car segment." Then, throwing every last chip on the pile, global design head Ed Welburn said the next Malibu's design will "make a significant statement" with "a very passionate design." Based on the number of comments Malibu posts get, we figure a fair few number of you would love for this to be the case; yet this is a lot of braggadocio to slather on a car that probably hasn't made "a significant statement" since Elton John had a number one record with Honky Chateau. That was 1972, if you're trying to remember. No matter the looks, the AN report says the new 'Bu will make a profit statement, selling for more money while costing less to produce. Alongside the Cruze, GM figures the pair will bring in an extra $800 million in variable profit in 2016. Which, in case it ends up being another 'butterface,' isn't bad for a silver lining.
