NHTSA slaps BMW with $40M fine for slow Mini recall

BMW is on the hook for a $40-million fine after the National Highway Traffic Safety Administration slapped the automaker over not recalling Minis that failed to meet minimum side-impact crash standards. The civil penalty from NHTSA concerns 2014 and 2015 Mini Cooper hatchback models that "failed a crash test designed to determine whether the vehicle met crash-protection minimums," the government agency said in a press release issued this week. An October 2014 test revealed the first problem, and the Mini was subsequently retested in July, only to fail again and finally prompt a recall of more than 30,000 cars. But according to NHTSA's investigation that was opened in October, BMW waited too long to issue a recall after it knew the cars did not meet standards and bring them into compliance with more energy-absorbing materials installed by Mini dealers. This is the second time NHTSA slapped BMW with a major penalty, following a $3-million fine back in 2012 failing to report recalls of its cars and motorcycles. "For the second time in three years, BMW has been penalized for failing to meet that obligation," NHTSA Administrator Mark Rosekind said in the release. "The company must take this opportunity to reform its procedures and its culture to put safety where it belongs: at the top of its priority list." In a separate release issued this week, BMW Group said it, "is committed to further improving its recall processes to better serve its customers," and that the company, "respects the role of NHTSA and looks forward to working with them to develop solutions for the future." Under terms of a Consent Order issued to BMW, the company acknowledges that it violated requirements to issue a timely recall of vehicles that did not comply with minimum crash protection standards, to notify owners of recalls in a timely fashion, and to provide accurate information about its recalls to NHTSA. NHTSA imposed a $3 million civil penalty to BMW in 2012 for similar violations.

Did BMW drag its feet on Mini recall?

The National Highway Traffic Safety Administration is opening an investigation into BMW's reporting of a recall for 30,456 examples of the 2014-2015 Mini Cooper Hardtop, Cooper S, and the 2015 John Cooper Works. According to the government, "it appears from a review of NHTSA's databases that BMW may have failed to submit recall communications to NHTSA in a timely manner." The automaker issued the recall in July because crash tests showed the models didn't meet side impact requirements for passengers in the back seat. While there were no reported injuries at the time, the company decided to install energy-absorbing material in the space between the rear interior panels and the exterior. However, NHTSA has decided to investigate whether this campaign should have started much earlier, given the evidence the company had. According to the government's report, the Cooper Hardtop failed side-impact tests in 2014, although one of these tests was five-miles-per-hour faster than the Federal Motor Vehicle Safety Standard. The agency claims: "In January 2015 BMW verbally committed that it would conduct a service campaign to add padding to the rear side panels of MY 2015 Mini 2 Door Hardtop Cooper models. However, BMW did not initiate the service campaign and failed to inform NHTSA of its failure to do so." A subsequent crash test of an example with this fix showed it to make the vehicle compliant with the rules. Mini spokesperson Mariella Kapsaskis told Autoblog: "Regarding the NHTSA audit query, BMW Group is evaluating the request and will respond to NHTSA as appropriate." Renault ZOE EVs took the top four places in the 2015 ZENN Monte-Carlo Rally. Renault's cars finished first in consumption, regularity and overall standings. ZOEs took the top four spots overall and in the regularity tests, and the top five places for consumption. Renault entered four teams - two with professional drivers (finishing first and second), one piloted by journalists (placing third) and another by bloggers (taking seventh place). Another individual team entered the race with their own ZOE and finished fourth overall. The electric vehicle race took place over 130 miles and seven and a half hours. Read more in the press release from Renault below. British Columbia has reinstated its Clean Energy Vehicle Incentive Program. Phase two of the program, which starts April 1, is expected to put another 1,700 plug-in cars on BC roads. It's funded by the province's Innovative Clean Energy Fund, which gets its money from carbon taxes. Customers can receive rebates of up to C$5,000 for EVs, while fuel cell vehicle customers could get back up to C$6,000. Drivers can also get up to $C3,250 for scrapping cars built before 2000. BMW is noticing increased sales of its i3 EV tied to government incentives for electric cars. "We can see a clear connection between sales figures and political initiatives," says BMW Group CEO Norbert Reithofer. "Wherever governments offer tangible incentives for e-mobility, the registration figures for the BMW i3 soar." Last year, BMW sold about 2,000 i3s in Norway and 3,000 in California. In Germany, where BMW only sold about 2,100 i3s, Riethofer suggests the government needs to do more to support clean cars. "The German carmakers have delivered their part of the bargain.
