BMW slapped with discrimination suit by EEOC

According to a report from CNNMoney, BMW has been hit with a lawsuit from the US Equal Employment Opportunity Commission after revised criminal background check policies resulted in the dismissal of 88 contractors, 70 of whom (that's about 80 percent) were black. A total of 645 contractors were required to submit to background checks at BMW's facility in Spartanburg, South Carolina after BMW switched contract companies at its plant.
Though the 88 persons who were not rehired by the new contractor all had criminal records, that may not necessarily be a legal way to screen applicants, as the EEOC counters: "BMW's policy has no time limit with regard to convictions. The policy is a blanket exclusion without any individualized assessment of the nature and gravity of the crimes, the ages of the convictions, or the nature of the claimants' respective positions."
BMW's actions were in violation of the Civic Rights Act of 1964, according to the EEOC, because they utilized "a criminal conviction policy that disproportionately screened out African-Americans." A recent bulletin offering guidance from the EEOC on the Civil Rights Act can be found here, but the EEOC's stance on the issue has been the same for years: "Since issuing its first written policy guidance in the 1980s regarding the use of arrest and conviction records in employment decisions, the EEOC has advised employers that under certain circumstances, their use of that information to deny employment opportunities could be at odds with Title VII."

If you've ever listened to the Autoblog Podcast, you've doubtlessly heard my views on the BMW 1 Series M Coupe. I don't much care for it. That's not to say it's bad, so much as it just isn't what an M car should be. Steven Ewing, Seyth Miersma and a number of other Autoblog staffers think I'm crazy (It's true, he is crazy –Ed.), but whatever. My position on the 1M would be dramatically different, however, had it been fitted from the factory with the truly fantastic 4.0-liter V8 from the E92 M3 (the last great M car, in this writer's humble opinion). Matt Farah of Drive took to the wheel of a 135i that's been completely reworked by Performance Technic and is owned by Marco Svizzero. The car required a salvageable E92 and what we imagine is an incalculable amount of wrench time, with the result being, as Farah says, "possibly the best BMW you could build at any price." BMW recalling 40k+ motorcycles to replace rear wheel flange

A problem with the rear wheels on a wide array of its motorcycles has prompted BMW and the National Highway Traffic Safety Administration to issue a recall for 43,426 vehicles. In the affected units, the mounting flange on the rear wheel is at risk of cracking if the bolts are over-tightened. If that flange cracks, "the rear wheel may not remain secured to the motorcycle," which is kind of important considering there are only two wheels on a motorcycle to start with. The recall affects certain model-year 1200 and 1300 models – including the R1200GS, R1200RT, R1200GS, R1200R, R1200S, R1200ST, K1200S, K1200R, K1200R Sport, K1200GT, K1300S, K1300R and K1300GT – as well as the HP2 Megamoto, HP2 Enduro and HP2 Sport. Owners of the affects units can expect to head from the manufacturer to arrange having the aluminum flange replaced with a steel one.
