BMW to pay $1.6M, rehire workers in discrimination settlement

A BMW subsidiary is on the hook for $1.6 million and must rehire workers as part of a settlement for a race discrimination lawsuit with the US Equal Employment Opportunity Commission. A change in BMW Manufacturing's criminal background check policy at the Spartanburg, SC, factory disproportionately affected African American workers, according to the EEOC, and it cost many people their jobs. The automaker has since changed the policy. According to Automotive News, the suit stemmed from BMW switching logistics contractors at the plant in 2008. As a result, 645 existing workers had to submit revised criminal background checks to keep their jobs. About 100 people didn't meet the new guidelines, according to the EEOC, and they lost their jobs. Around 80 percent of those affected were African American. According to the government agency's complaint, the altered procedures only took into account the category of a crime, not factors like when it occurred or whether the infraction was a misdemeanor or felony. With the settlement accepted by US District Court, BMW must offer work to the affected employees in this case and as many as 90 African American applicants that the contractor didn't hire because of the rules. The automaker also must offer training in the proper manner for criminal background checks. While there's nothing inherently wrong with investigating workers, "when a criminal background screen results in the disproportionate exclusion of African-Americans from job opportunities, the employer must evaluate whether the policy is job related and consistent with a business necessity," P. Audi and Mercedes both outsell BMW in January

There won't be any celebrations in Munich this month, as BMW was outsold by arch-nemeses Audi and Mercedes-Benz. The Bavarian company finished behind Audi in January, which took the top spot for the first time since June of last year, Bloomberg reports. Ingolstadt rode high on a 10-percent bump in sales, while Mercedes saw a larger 14 percent increase. BMW, meanwhile, only saw a modest 6.3-percent sales increase last month, thanks in large part to its struggles in China. The company's sales there increased at about half the rate of its chief competitors, with a 7.9-percent jump to Mercedes and Audi's roughly 15-percent increases. Perhaps more worrying for BMW, though, is that this could become something of a trend for the company. According to Bloomberg, issues with Chinese dealers who cancelled orders over sales targets and bonuses combined with what the publication calls aging models, could spell bad news for the German marque. "This looks like a pretty significant decline in growth compared to Mercedes and Audi," Bankhaus Metzler analyst Juergen Pieper told Bloomberg. BMW adds on-street parking to DriveNow carsharing in SF

BMW is putting a new spin on the concept of the San Francisco treat. The German automaker cut a deal to clear out 80 street-parking spaces for its DriveNow car-sharing program in the notoriously parking-constrained City by the Bay. Bimmer is also more than doubling its all-electric ActiveE car-sharing fleet in San Francisco to 150 vehicles from 70. Starting later this month, customers will be able to access the DriveNow website or app to find, reserve and park the electric Bimmers on certain streets in San Francisco's Mission district. Once the car is ready to be turned back in, the vehicle's in-car screen will also indicate what "drop-off" zones the driver can use to end the reservation. It's all very high-tech, and BMW is looking to expand the program to other San Francisco neighborhoods like Bernal Heights, the Haight, Noe Valley and Potrero Hill. There's also a contest for users to name the 80 new vehicles, but it involves a really complicated lettering system. "New" here means new to DriveNow, since these ActiveE electric vehicles are really those that were, until recently, used by the Electronauts in BMW's EV leasing program. Since those leases are ending, the cars need to go somewhere. We think carsharing is a great home for them. BMW, which also runs DriveNow in the German cities of Berlin, Hamburg, Cologne, Munich and Dusseldorf, said in March that it was looking to add the service to as many as 15 more cities in Europe as well as another 10 in the US.
