BMW slapped with discrimination suit by EEOC

According to a report from CNNMoney, BMW has been hit with a lawsuit from the US Equal Employment Opportunity Commission after revised criminal background check policies resulted in the dismissal of 88 contractors, 70 of whom (that's about 80 percent) were black. A total of 645 contractors were required to submit to background checks at BMW's facility in Spartanburg, South Carolina after BMW switched contract companies at its plant.
Though the 88 persons who were not rehired by the new contractor all had criminal records, that may not necessarily be a legal way to screen applicants, as the EEOC counters: "BMW's policy has no time limit with regard to convictions. The policy is a blanket exclusion without any individualized assessment of the nature and gravity of the crimes, the ages of the convictions, or the nature of the claimants' respective positions."
BMW's actions were in violation of the Civic Rights Act of 1964, according to the EEOC, because they utilized "a criminal conviction policy that disproportionately screened out African-Americans." A recent bulletin offering guidance from the EEOC on the Civil Rights Act can be found here, but the EEOC's stance on the issue has been the same for years: "Since issuing its first written policy guidance in the 1980s regarding the use of arrest and conviction records in employment decisions, the EEOC has advised employers that under certain circumstances, their use of that information to deny employment opportunities could be at odds with Title VII."

Did BMW really win the luxury car sales race?

As anyone who follows our monthly By The Numbers series already knows, the luxury car sales race in the United States was close all of last year as BMW, Lexus and Mercedes-Benz seesawed up and down for sales supremacy. At the end of the year, it was BMW on top of the standings with 346,023 total sales. Or was it? According to data released by Polk, comparing the actual number of vehicles registered between the three top luxury players in the US paints a slightly different picture. Polk's data suggests that only 335,259 BMWs were registered in 2015, compared to 340,392 Lexus models. Why the disparity? It's all a matter of timing. Actual end consumers buy new cars, in almost all cases, from a franchised dealer. BMW delivered 346,023 vehicles in 2015, but only 335,259 of them were registered by their new owners. Presumably, those 11,000 BMWs did (or will) end up registered in the driveways of consumers, but they hadn't before January 1, 2016. Lexus General Manager Jeff Bracken wrote in an email to Automotive News, "Luxury sales leadership as measured by vehicle registrations is important to Lexus as it represents actual consumers engaging directly with our dealers." Of course, it goes without saying that we'll be paying keen attention to the 2016 luxury car sales race as it unfolds. If it's anything like it was in 2015, it'll come down to the wire, and even then may not be entirely clear. BMW M4 Concept bows, takes handoff from M3 Coupe

Remember how, when the first BMW M4 Concept images leaked earlier today, we told you the official information would be coming later this evening? Well, scratch that. The whole kit and caboodle is now online, meaning all the official details are below, as well as a full gallery of high-res images above.
The replacement for the M3 Coupe, the Concept M4 Coupe shares a number of styling similarities with its dearly departed forbearer. To us, it's kind of like a mishmash of greatest hits from the new 4 Series and the old M3. The 4 Series headlights have grown on us, and the side grilles, which are part of BMW's Air Curtain and Air Breather system, are functional.
The power dome in the hood is smaller than on the M3, but is of a similar shape, while the rear diffuser and exhaust treatment look like they're lifted straight from the old car, aside from being finished in carbon fiber. Speaking of which, the carbon fiber roof sports a new touch, a cool BMW M tri-color that runs the length of the roof on the driver's side. The 20-inch M alloy wheels come in a twin five-spoke design, which has sort of become a calling card of BMW's M cars in recent years. Hiding behind those meaty wheels are M's carbon-ceramic brakes.
