Aston Martin sues Henrik Fisker over Thunderbolt design

Imitation is supposedly the sincerest form of flattery, but Aston Martin isn't blushing after taking a look at the Fisker Thunderbolt. The british luxury brand has filed a lawsuit against the designer for allegedly copying the company's designs without permission in a US District Court in California. Fisker unveiled the Thunderbolt at the at the 2015 Amelia Island Concours d'Elegance as his own take on the Vanquish. The former Aston Martin stylist's changes included reshaping the grille, adding a power dome to the hood and incorporating wraparound rear glass. The version on display was a concept for the design, but the plan was to sell a slightly modified production version through Galpin Aston Martin. This lawsuit puts assembly in doubt. "This lawsuit centres on Henrik Fisker's creation and promotion of automobiles that Aston Martin contends infringes Aston Martin's rights, by an improper and unauthorised attempt to exploit and free-ride off them," said a portion of a prepared statement from the company emailed to Autoblog (embedded in full below). According to Bloomberg, the automaker claims in the suit that portions of the design, including "the famous Aston Martin mark, wings logo, side vent mark, and Vanquish mark" are being coping in Fisker's design. The business also calls the plan to change the design for the production version a "bait-and-switch." Fisker helped to shape the look of the Aston Martin DB9 and V8 Vantage during his time as a designer at the brand. "Today Aston Martin filed a lawsuit in the state of California to protect its valuable trade marks, designs and intellectual property rights. This lawsuit centres on Henrik Fisker's creation and promotion of automobiles that Aston Martin contends infringes Aston Martin's rights, by an improper and unauthorised attempt to exploit and free-ride off them. Aston Martin regards such conduct as wholly unacceptable and reserves all rights available at law to challenge it."

Aston Martin brings ice driving program to America [w/video]

With between four and six hundred horsepower channeled to the rear wheels from a V8 or V12 engine mounted up front, an Aston Martin – any Aston Martin, really – might not seem like the smartest choice for driving on ice and snow. But that can also make it the most fun, and the most enlightening to experience. That's the point behind the Aston Martin On Ice program: allowing customers to drive the latest Gaydon has to offer on slippery, wintery surfaces. But whereas the On Ice program has been established for years in St. Moritz, Switzerland and in the Swedish Lapland, this year it arrived in America for the first time. A series of custom tracks – including a braking/cornering loop, slalom, skid pad and a full circuit – were carved into the snow in Crested Butte, CO, where expert driving instructors taught customers a thing or two about how to handle a powerful twelve-cylinder GT car like a DB9, Vanquish or V12 Vantage. The program has concluded for the season, returning next February, but in the meantime Aston will use the Colorado base camp as the center of its driving experience through the Rockies. Comprising a braking/cornering exercise loop, slalom, skid pad and full circuit, the bespoke Aston Martin track was especially constructed for the occasion over the last four months. Aston Martin may be forced to stop selling DB9, Vantage in US [w/poll]

There are any number of factors that are making it increasingly difficult for a small-scale, independent automaker like Aston Martin to stay competitive in today's automotive marketplace, from purchasing power to R&D capacity. But the latest factor endangering Aston's viability on the marketplace seems to be coming down to tighter government safety standards. The National Highway Traffic Safety Administration is enacting new side-impact crash regulations that require vehicles to better withstand the impact from running into a pole or tree – narrow-gauge fixed objects you're likely to find lining public streets. The standard has been phased in over the last few years, but while an exemption to the gradual phase-in was granted to low-volume manufacturers, even those automakers will have to meet the cut-off next month. And convertibles (which were granted a further extension) will have to meet them by September 2015. Unfortunately for Aston Martin, two of its core models – the Vantage and DB9 – do not pass the test. That would mean that it would have to stop selling both those model lines (which just also happen to be its oldest), but a spokesman for the brand's US dealers is petitioning the government body to grant them an exception. According to James R. Walker, chairman of Aston's US dealer advisory panel and owner of the dealership in Washington, DC, losing the V8 Vantage coupe, V12 Vantage coupe and DB9 coupe next month would cost dealers about 25 percent of its gross profits, and losing the convertible versions of the same next year would cut another 40 percent of their profits. The combined 65 percent drop in sales (assuming, of course, that sales of the recently updated but more expensive Vanquish and Rapide wouldn't rise to make up for it) would mean that many of the 35 dealers across the US would have to close, putting the 230 people who work at the dealers (and another 300 related personnel) out of work. On that basis, Walker is asking the government to grant an exemption for the DB9 through August 2016 and for the Vantage through August 2017. By then, we're lead to assume, their replacement (or replacements) will have arrived, meeting the new crash standards.
