GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Weekly Recap: Electric Rapide concept showcases Aston's future

Aston Martin showed off an all-electric Rapide S prototype this week and announced an agreement with investment firm ChinaEquity to explore development of a production version of the sports sedan. The car could arrive in about two years if the project advances, and it would be built in Gaydon, England. The concept car, called the "RapidE" was developed with Williams Advanced Engineering. The electric Rapide is meant to highlight British innovation, and it was revealed during a state visit by Chinese president Xi Jinping to the United Kingdom. Spec were not available for the concept on display. "The car we showed in London is a fully running concept but not yet defining [of] our choice of battery, motor, inverter, etc," spokesman Simon Sproule said. "Now that we have a clearer path for producing the car, we will be defining all the parameters." Aston Martin has been vocal about its electric ambitions this year, and Sproule told us at the New York Auto Show that an all-electric Rapide could cost $200,000 to $250,000 or more. "It's a study, but we're serious about it," he said. Some reports have indicated the electric Rapide could pack as much as 1,000 horsepower. Aston considers electric technology the strongest play for modernizing its powertrains and meeting emissions standards around the world. Hybrids and all-electric models can offer high outputs and strong torque delivery, which is in keeping with the Aston's image as a sportscar maker. Company brass prefer this option over dropping down to four-cylinder engines. And yes, V8s and V12s remain part of the plan. The electric push is part of Aston's future strategy to remake its lineup, which includes refreshing its sportscars, building a production version of the electric all-wheel-drive DBX concept shown at the Geneva Motor Show, and adding a four-door Lagonda. OTHER NEWS & NOTES Domino's serves up purpose-built delivery car Domino's revealed a purpose-built pizza delivery car based on the Chevy Spark. It's called the DXP, for Delivery Expert, and it can handle up to 80 pizzas. The pies stay warm thanks to an oven located behind the driver's seat, and the DXP is sauced up with a puddle-lighting feature that projects the Domino's logo outside of the car. Power comes from the Spark's stock 1.2-liter four-cylinder engine rated at 84 hp that gets up to 39 mpg on the highway. Chevy dealers will be trained to service the DXP.

Europeans ask Chevy to bring Volt back to Europe

A group of French fans is asking for a jolt of support from General Motors to get the 2016 Chevrolet Volt across the pond. The Association Amperistes et Amis des Vehicules Rechargeables is running a Change.org petition that currently has 383 signatures out of a goal of 500. While the attempt is admirable, it's probably going to take a lot more than several hundred people for the model to make a return to the continent after the poor showing of the Opel Ampera – first-gen Volt's European cousin. The group's major argument for bringing a version of the second-gen Volt to Europe is that consumers need "an intermediate choice between expensive or range-limited pure electric cars and plug-in hybrids with a miserable electric range." Furthermore, such a vehicle would prod the competition to produce similarly efficient electrified models. They also lavish praise on the abilities of the Ampera for its long EV driving range. The supporters aren't entirely kind to GM in the petition, though, and claim the company excluded the original car from marketing efforts there. The Ampera actually enjoyed a strong European launch with more orders than initially expected and briefly topped the best-sellers list among EVs there. It was even named 2012 European Car of the Year. Those halcyon days didn't last long, and by 2014 sales fell off to a trickle. The waning reception caused GM's decision not to introduce a version of the new 2016 Volt there or in Australia. Related Video:
