GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. This GTO-El Camino mashup is the muscle truck of our dreams

There were a hell of a lot of great muscle cars in the mid-1960s, from the baroque Dodges and Plymouths of the earlier part of the decade to the wild big boys like the Boss 429 and Olds 442 W30. Right in the middle of the decade, two of the most iconic of the bunch emerged — the Pontiac GTO and second-generation Chevy El Camino. And this one is a 1964 Chevy El Camino with the heart and face of its GTO cousin, and dubbed the El Chieftain GTO. It's currently for sale at RM Sotheby's Auburn auction, with no reserve status or estimate listed. This looks like a product that Pontiac could have sold at the time Β— its builder, Ron Lindeman, did an excellent job making it look like a factory product, right down to the taillight strakes inspired by the GTO. It's powered by a 389 Β— a Pontiac motor that was actually found in period GTOs, but sporting a single four-barrel instead of the sexy Tri-Power setup. It is, however, equipped with a Hurst four-speed manual and the grille badge to prove it to bystanders. Even the interior is made up to look like a GTO. We wish there was more of a description of the build in the listing, but if you love it, do us one better and buy the thing and invite us to poke around it. We are very much in love with this muscle-truck mashup. Junkyard Gem: 2000 Pontiac Sunfire coupe

In a few months, we'll reach the tenth anniversary of GM's axing of the venerable Pontiac brand. G6s, Vibes, and Matizes continued to be built until 2010, but I'm noticing a marked decrease in discarded Pontiacs lately, as I perform my junkyardy rituals. Here's a 2000 Pontiac Sunfire, photographed in a Colorado wrecking yard. The Sunfire was the near-identical sibling to the Chevrolet Cavalier, based on the long-running (1982-2005) J-Body platform. It was cheap and simple, looked pretty sporty (at least in coupe form), and every parts store in North America carried just about everything you'd need to keep one running. This coupe had to compete for sales not only with a vast and menacing array of imports but with GM's own Saturn SC2 (not to mention the Cavalier itself). Meanwhile, the J platform was showing its age more with each passing year. This car sports what must have been the complete line of Fatal Clothing bomber-nose-art/skate-punk/gang-tag-influenced decals, circa 2010. I actually photographed this car back in 2011, then misplaced the image files until last week. The stickers are very California-centric for a Colorado car, but then plenty of Californians — including meΒ— move here. When you know you're a car's final owner, it's a lot easier to whip out the paint pens and redecorate the interior. Power came from the engine GM developed for the very first J-Bodies: the 2.2-liter 122 pushrod four-cylinder. 2002 was the last model year for 122-powered Sunfires and Cavaliers; the most affordable S-10/Sonoma/Hombre trucks got this engine through 2003.
